issues as of 8/14/2020

1) Trustee supplemental objection to modified plan after confirmation filed:
-Further issues need to be addressed. The plan states that all arrears and balances of two cars
were paid in full outside of the plan. Debtor did not provide amounts paid or the source of funds for payment.
-The two creditors are Steward Financial Services (2014 Chevrolet Cruze) and Americredit/GM Financial (2014 Chevrolet Traverse).
-Per the petition Americredit/GM Financial was listed at $32,866, the filed claim(#6-1) listed $32,884.27 secured and arrears of $1,270.37.
-Steward ,listed in petition $21,528 did not file a claim . There are two orders 4/12/2017(#45) and 9/17/2019 (#114)resolving defaults with creditor ,Steward.
- It appears debtors somehow had significant funds to pay off both cars.
-Trustee requests information on the alleged payoffs of these cars. Americredit has not amended their claim as of now.
-In addition, the debtors are also in arrears to the Trustee in the amount of $2,252.

8/14/20:(mk): also DS got adj request from debtor but also suggested an interim Order- AR to review.

8/14/20(mk): Proposed Consent Order w/ IRS submitted to chambers. Says IRS will assess return and then set off for 2019 and then amendd POC. No deadline. I objected and said the following: The Trustee has a limited objection to the Order. The case is currently on for confirmation for 8/19/20 and has Issues.
The IRS claim is in the amount of $110,000 and is "per debtor records" which the Trustee does not consider as estimated and
has the claim set up for payment. As of now the proposed payments look to cover the priority claims and if the claim is amended for less,
then the funds should go to unsecured creditors since the disposable income supports the proposed payment. There Is no deadline in the proposed Order for this amended claim to be filed . Therefore, the Trustee requests a revised Order be submitted that includes language to state that the Trustee will pay on the claim unless or until amended . Any overpayment made by the Trustee to the IRS, prior to the Amended claim, if any ,will be refunded to the Trustee and not the debtor.

As of 8/13/20 (DS): 1. Trustee obj to the following:
- Debtors income, even adjusting for the one time incentive income is higher $14,000 than scheduled $12,970.96.
- Part 1e of debtor's plan states "the non-exempt equity on Schedules B & C of about $37,500 will be applied to the general unsecured creditors". However, Part 5 a of the plan only proposes a pot based plan. It should be a dollar base plan with a minimum of $37,500 to gucs.
- Certification regarding sale of debtor's interest in Forum Analytics and his equity share in his current job at Tenna. (SUPP TR. OBJ. FILED).
- The amount of debt in the debtor's Plan exceeds the statutory limit for secured or unsecured debt pursuant to 11 U.S.C. ? 109(e), total unsecured claims filed $421,799.26.

1. Objection filed by Jet Care (Bell & Shivas) - only states that creditor joins in the trustee's objection.

2. Trustee's objection:
The debtor(s) is not paying all disposable income into the plan pursuant to either Schedules I & J or Form 22C based upon the Trustee's review of the income and tax returns provided. The Trustee's calculations are higher for the following reason(s):
-spouse income, based on proof of income provided, verifies at $52,200.64, Schedule I only listed income as $4,550.09 - based on excess income in the amount of $49,728.71 - this plan must be a 100% plan
-excessive expenses on Schedule J - $300/home maintenance; $650/utilities; $834.91 for health insurance- needs proof (NO PROOF RECEIVED)
-need explanation and proof for proposed large reduction in the Trustee payments in month 3 of plan. (NOT RECEIVED)
- The Schedules fail to account for the debtor(s) tax refund in the amount of $6694 when determining disposable income. (AVERAGED/ADDED TO INCOME)
- need better explanation of spouse income: there were 2 checks for each pay period. One is for $2,100.03 and bi weekly that is $4,536.06 net per month. The 2nd check each pay period is a different amount each pay period ranging from $18,913.04 to $25,220.23 - there is no explanation on the check and this income was not reported on the schedules. (NO EXPLANATION RECEIVED)
-review of bank statements provided show higher balances than reported on Schedule B as follows: Bank of America (Checking) $835.79 as of 5/11/2020 statement provided; Bank of America (Savings) $1,629.55 as of 5/5/2020 statement provided; Manasquan Bank (checking) $473.72 as of 6/15/2020 statement. Must Amend Schedules B and C to reflect correct balances and exemptions accordingly (SCHEDULES NOT AMENDED)
- Capital One statement showed a savings account with a balance of $2,944.75. Need proof that this is a custodial acct for minor child. (NOT RECEIVED)

Plan proposes: $1,695 x 2, $308 x 58, base
