ISSUES AS OF 4/12/2024 (DM):

***Debtor has not started making the higher tier payment in the proposed plan***

***Per latest online comps the house value far exceeds the $35,000 in unsecured creditors. Comp show $387,000 value. House is in good condition per photos. Balboa asked for updated CMA a year ago because comps were from 2021 and beg of 2022. Also many comps were for houses half the size of the debtors house. Debtor now says he got new comps recently but hasnt submitted them. It needs to remain 100% but debtor does not appear to have income now that wife lost her job. Needs to re-file.

1) Wells Fargo filed a bifurcated claim for Bob's Discount Furniture in the amount of $389.18 secured and $1,259.36 unsecured not treated in the plan (TREAT CLAIM AS FILED??)

2) Trustee Balboa Notes:
- When does Cenlar pension loan payment ($265.39 bi-weekly) end for spouse, when was it taken out, what is the payoff, and what was the original amount? (UNRESOLVED)
- CMA disclaimer (only received comps). Also, CMA is from May 2022 (UNRESOLVED).

 Otherwise, would need $1,285 Ptd, then $1,060 x 54 (beg. Sept. 2023) 100% due to Trustee's 122c-2. Atty Fees $4,150/$4,150.

***RESOLVED ISSUES***

A) Freedom Mortgage (BROCK & SCOTT) OBJs - creditor filed $3,740.99 arrears claim on the Lock Ave property not treated in the plan (CONSENT ORDER ENTERED TO PAY ARREARS.)

B) Trustee Balboa Expense OBJ:
- Excessive Expenses: $870 electric/heat/gas, $634 tele/cell, $1,400 food, $450 personal care, $580 transportation, $200 entertainment (AMENDED SCH J COVERS SOME OF THESE EXPENSES.)

C) Trustee Balboa Notes:
- Need amended Sch I: Atty advised that Debtor is no longer a part-time bartender so line item should be removes. Also, there is -$1,229.06 in monthly net disposable income. Plan is NOT feasible, please review. (AMENDED SCH I&J FILED.)
- When does Mt. Ephraim Board of Ed pension loan payment ($392.14 bi-weekly) end, when was it taken out, what is the payoff, and what was the original

3/26/24(mk); email from Laura Egerman @McCalla:
have spoken to M&T Bank about the mortgage loan for this case and your client's desire to cure/maintain the mortgage that his mother took out on the subject property. Debtor is, to my understanding, not in title to this property but you had indicated at the hearing on 03/20/2024 that you were looking into whether there is an Administrator's Deed from the mother's estate into the debtor and/or debtor and his sister.

M&T has asked for additional information about the Administrator's Deed; M&T has asked that any order resolving the plan objection include language about the Administrator's Deed and title being put into debtor's name. I have also been advised has advised that if debtor is able to cure the arrears and maintains the ongoing payments on the account that it will not foreclose.

Please advise so we can hopefully move this matter forward
