-The trustee objects to the modification of the plan. The debtor defaulted on the original plan, requiring a trustee certification of default in June of 2025. A modified plan was filed in response and was confirmed in June of 2025 allowing for a delay in the loan mod deadline, a reduced payment and a large step up.
Once the modified plan was confirmed the debtor immediately stopped making payments forcing the latest trustee certification of default in September of 2025. Counsel filed another modified plan in response and wants to once again push back the loan mod deadline, reduce payments for several months followed by a large step up.
The pattern of missed payments and large step ups show that the past and current plans are not feasible and a showing of bad faith. The debtors can continue to pursue and complete the trial loan modification outside of the plan. Once that is completed they can file a new case should file a new case if necessary allowing for 60 month cure.
